§ 745.80 Purpose.
This subpart contains regulations
developed under sections 402 and 406
of the Toxic Substances Control Act (15
U.S.C. 2682 and 2686) and applies to all
renovations performed for
compensation in target housing and
child-occupied facilities. The purpose of
this subpart is to ensure the following:
(a) Owners and occupants of target
housing and child-occupied facilities
receive information on lead-based paint
hazards before these renovations begin;
and
(b) Individuals performing
renovations regulated in accordance
with§ 745.82 are properly trained;
renovators and firms performing these
renovations are certified; and the work
practices in § 745.85 are followed
during these renovations.

Notice it specifically says Lead Based Paint

If you do not disturb more than 5 sq. ft. of paint you are golden.
If my customer wants his shoe or baseboard replaced. let him remove it and I will install new

I like your interpretation Tim! Thanks for clearing that up. There's so much misinformation out there. Mainly by the ppl who are going to make a buck off of you by suckering you into taking classes for it. Not to mention the .gov is kinda vague about the wood flooring biz.

Like I mentioned before, whats wrong with the old statutes? Yea if you see paint on the floor, test it or walk away. Same as the asbestos deal.
You might want to check this out too.

All surfaces affected by a renovation covered by the Renovation, Repair and Painting Rule must either be tested for lead-based paint or presumed to contain lead-based paint. Testing must include all affected surfaces coated with paint, shellac, varnish, stain, coating or even paint covered by wallpaper, if it will be disturbed during the renovation work. A report documenting the testing must list the surfaces tested and the surfaces which contain lead-based paint. If lead-based paint is present on an affected surface, then the lead safe work practices described in this pamphlet must be used on the job.

Dave, I just got off the phone with the EPA.
The pamphlet you mention is for a person testing a home for Lead.
They must test all surfaces as you see in the pamphlet.

We are talking about 2 different things.

The EPA also told me that if I do not disturb any painted surface, I DO NOT need the certification for Lead.
I asked about cutting door jambs for a new install. She said that unless it's over the 5 sq.ft I am golden. She said that I would not go over this area when cutting Jambs. ( I told her the process)

I also requested an E-mail that will give me an answer to the floor refinishing VS lead issue.
I want this as a protect my ass E-mail to keep on record.

This person will be the district leader out of Phila, and he is going to call me tomorrow.

Mr Ellis confirmed that I do not need this.
If in doubt, call your local EPA office.
When I called the Fed info line they said yes I need it.
When pressed for an explanation, they put me on hold, then told me to call my local office.
Thats very clever thinking Selva. Thats why you are an inspector and me dumb layer hehe
There was no lead residue in the sand.....really......... Your place might be eligible for a super fund funding. I'm calling the feds. And then the revenuers for that stil you got in the back too..

I been working ina house built in the fitty's righ now. Oh no, I no touchy any paint cept to undercut casings.
